These Terms of Service ("Terms") constitute a legal agreement defining the terms and conditions on which DREAMSPARK PTE. LTD. ("We") grants access to the Heros Go (the "Game") or its applications for mobile devices or other applications (collectively, "Services") to an end user ("You" or "User")
Please read the Terms carefully. Please note that by accessing or using our Services, you agree that you have read, understood, and accepted the Terms. If you do not agree to the Terms, please leave this page and stop accessing our Services. Please note that we reserve the right, at any time and in our sole discretion, to modify or revise the Terms, and you agree to comply with such modifications or revisions hereof.
You must be at least 13 years of age to access and use our Services. If you are at least 13 years of age but below 18 years of age or any other age of majority required for this Agreement to be binding for you in your country of residence ("Age of Majority"), your parent or legal guardian must establish an Account with us. Please note that by establishing an Account for use by their child/ward or otherwise permitting their child/ward to access our Services through their Account, parents and legal guardians guarantee that the child/ward should comply with the obligations under this Agreement.
We do not warrant that our Services will be compatible with your mobile device or other device/equipment. It is your sole responsibility to ensure that you use a compatible mobile device and any other device/equipment to access and use our Services. Please note that all fees incurred in accessing our Services (including data charges, without limitation) shall be charged to you.
Subject to these Terms, a non-exclusive, non-transferable, non-sharable, revocable, limited license is granted to you to use our Services solely for your personal, non-commercial use in accordance with this Agreement. You agree to use our Services only for lawful purposes and in a way that does not infringe the rights of any third party or inhibit their use of our services. Please note that we are entitled to immediately terminate this license, without any liability to you in case you violate the Terms.
Our Services use content that is owned by us and/or our licensors, and is protected by copyright, trademark, and other intellectual property laws. We hereby reserve all rights, including without limitation, intellectual property rights and other rights, in respect of our Services. You shall not use our Services or the intellectual property contained in our Services in a manner that infringes on our right or the rights of our licensors..
When your Account has been opened, you may be required to choose a name to identify yourself ("Account ID"). Your Account ID should not be a name which violates any third party's trademark right, copyright, or other proprietary right, or which may mislead others to think you are employed by our company, or which we deem to be offensive, in our sole discretion. You agree that we, in our sole discretion and at any time, reserve the right to change, terminate or suspend access in case an Account ID is offensive or inappropriate. We also reserve the right, in our sole discretion and at any time, to delete or change your character name for certain services that we deem to be inappropriate or offensive. You are solely liable for all activities conducted through your Account or under your Account ID or character name.
Please note that your account is for your personal use only. You specifically agree not to: (1) share your account credentials with anyone else, (2) sell, propose to sell, rent, lease, trade or otherwise transfer your account to anyone else for any reason, (3) sell, propose to sell, rent, lease, trade or otherwise transfer any ??Gold" or other virtual currencies, game resources, in-game services such as ??speed-ups,?? or any other in-game items associated with your account (collectively, "In-Game Items"), except for doing so using mechanisms within the Game that are specifically provided for non-commercial transfer of In-Game Items to anyone else for any reason, (4) buy, propose to buy, accept, access or use any other user??s account or In-Game Items, except for doing so by using mechanisms within the Game that are specifically provided for non-commercial transfer of In-Game Items, and (5) link to or otherwise endorse or identify any websites, organizations, or persons that sell, propose to sell, rent, lease, buy, propose to buy, accept, access, trade or otherwise transfer accounts or In-Game Items. You acknowledge that any purported transfer of Game accounts or In-Game Items in violation of these Terms, including but not limited to transfers in exchange for money or other compensation, are void and in violation with these Terms, and that we are not obliged to assist you in completing any such transaction. You agree that we have the right to terminate or suspend your account and/or your right to access or use the Game if we discover or have grounds to reasonably suspect that you have attempted to buy, sell, rent, lease, license, or transfer your Game account or associated In-Game Items, or used or accessed an account or In-Game Items transferred by another user, or linked to or otherwise endorsed or identified any website, organization, or person that attempt to buy, sell, rent, lease, license, or transfer accounts or In-Game Items or conducted any other transactions in violation of these Terms.
You hereby agree to comply with the following rules of conduct/usage when you access and use the Game: (1) you shall comply with your obligations to third party mobile platform providers, including, without limitation, Apple and Google, from whom you download the Game, including compliance with any terms regarding payment for In-App Purchases made through such platforms; (2) you shall not attempt to obtain login information or access another player??s account, collect or harvest personal information from any other users for any purpose; (3) you shall not exploit, distribute or publicly inform other users of any game error, glitch or bug which enables an unfair advantage or allows impersonation of another party, including doing so by use of automated collection mechanisms such as clear graphics interchange formats, cookies, or similar technology for any purpose; (4) you shall not exploit differences in pricing for In-App Purchases or In-Game, through arbitrage or in any other manner, by sending altered, deceptive, or false source-identifying information, including but not limited to, by use of a proxy or spoofed IP addresses or VPNs, or by requesting that someone else make In-App Purchases or purchase In-Game Items on your behalf in order to take advantage of a difference in pricing; (5) you shall not harass, threaten or bully any other player, nor post or submit any abusive, threatening, bullying, harassing, obscene, defamatory, offensive, pornographic or illegal content, or content that infringes on or violates the rights of any other person, or impersonate any other person; (6) you shall not use the Game for any unauthorized commercial purpose, including but not limited to commercial advertisement or solicitation (such as chain letters, junk e-mail, ??spam?? or other repetitive messages), or gathering or transferring In-Game Items for sale; (7) you shall not use the Game for performing in-game services for remuneration, such as leveling up or item collection services; (8) you shall not use or design cheats, exploits, automation software, bots, hacks, mods or any unauthorized software designed to modify or interfere with the Game experience; (9) you shall not remove or obscure any proprietary notices within the Game; (10) you shall not disrupt or attempt to disrupt the Game or any other person??s use or experience playing the Game; (11) you shall not attempt to gain an unauthorized access to the Game, to accounts registered by others users, or to networks from which portions of the Game are provided, including doing so by circumventing or bypassing robot exclusion headers or security mechanisms of the Game; (12) you shall not use any service or software that accesses, intercepts, "mines," or otherwise collects information from the Game or that is in transit from or to the Game; (13) without our prior written consent, you shall not make any automated use of the Game, or take any action that imposes an unreasonable burden on our infrastructure in any manner; (14) without our prior written consent, you shall not use any software, technology, or device to send content or messages, scrape, spider, or crawl the Game, or harvest or manipulate data from the Game; (15) you shall not improperly use our support services, including doing so by submitting false reports; (16) except where permitted by law or relevant open source licenses, you shall not modify, reverse engineer, decompile, disassemble, decipher or otherwise try to derive the source code for the Game; (17) without our prior written consent you shall not copy, modify or distribute content from the Game; (18) you shall not advocate, promote, encourage, or otherwise facilitate any illegal behavior, including, without limitation, the use of illegal drugs, unlawful gambling or theft. You agree that your failure to comply with the aforesaid rules of conduct/usage may result in the suspension of your account, or any portion of your account, and/or subject you to the penalties as we deem to be reasonable or necessary in our sole discretion.
Our Service may provide communication channels such as forums or chat areas ("Communication Channels") to enable you to communicate with other Service users. We are not obliged to monitor these communication channels but we reserve the right, at our sole discretion, to review information posted on the Communication Channels and to remove any such information, at any time, without prior notice and at our sole discretion. We may also terminate or suspend your access to any Communication Channels at any time, at any time, without prior notice and at our sole discretion. You agree that your communication via the Communication Channels is public; you have no expectation of privacy regarding your use of the Communication Channels. We are not responsible for information that you choose to share on the Communication Channels, or for the actions of other users.
You agree that your use of the Service shall be lawful and that you will comply with the usage rules. You agree not to use our Service to transmit or otherwise disseminate information that is obscene, indecent, vulgar, pornographic or otherwise offensive or inappropriate. You agree that we may remove any information you transmit through the Communication Channels which we deem to be harmful, offensive, or otherwise in violation of these Terms at any time at our sole discretion.
We reserve the right to occasionally interrupt the Services on a regularly scheduled basis or in any other manner, with prior notice or without such notice, in order to perform maintenance procedures. You agree that our Services may be interrupted for unforeseeable circumstances or causes beyond our reasonable control, and we cannot guarantee that you will be able to access our Service or your Account whenever you may wish to do so. In any event, we shall not be liable or provide any compensation for any interruption of the Service that was caused by unforeseeable circumstances or causes beyond our reasonable control.
Our Service, the Account and any other game resources we own are provided to you on an "AS-IS" basis. We provide no warranties or remedies for our Service. You acknowledge that we are not responsible for any damage, loss, liability or result caused by widgets from other developers. We and our suppliers disclaim all express, implied or statutory warranties relating to the Service, including without limitation, merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that use of the Service will be uninterrupted, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.
Neither we nor our suppliers shall be responsible or liable with respect to any subject matter of these Terms or terms or conditions related thereto under any contract, negligence, strict liability or other theory for loss or inaccuracy of data or cost of procurement of substitute goods, services or technology, or for any indirect, incidental or consequential damages including, but not limited to loss of revenues and loss of profits. Our aggregate cumulative liability hereunder shall not exceed fifty dollars ($50.00) or the amount paid by you for the Service that caused such damage. Notwithstanding the foregoing, the exclusion of certain warranties or the limitation or exclusion of liability may not be permitted by relevant laws in some cases. Therefore, some of the limitations herein may not apply to you.
These Terms and the licenses granted hereunder are effective on the date you accept these Terms and shall be in force unless these Terms are terminated pursuant to this section. We may suspend or terminate your Account and/or access through your Account for an indefinite period of time, terminate your Account and/or access through your Account and/or terminate these Terms immediately and without notice in case you breach these Terms or any terms of service or privacy policy of any third party platform such as mobile platforms or if we, at our sole discretion, believe you to have willfully infringed on any third party intellectual property rights, or if we are unable to verify or authenticate any information you provide to us, and in such case, you will lose access to the Services including all the game resources, and we shall not have any obligation to refund any fees you paid or provide any other compensation for game resources you have not used or otherwise have any other liability whatsoever in regard to you.
This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China without giving effect to conflict of laws principles; all disputes, controversies or claims arising out of or in connection with this Agreement, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it, shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre ("HKIAC") under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The number of arbitrators shall be three. The venue of arbitration shall be Hong Kong. The language of arbitration shall be English.
